Terms & Conditions (T&Cs) of the ProLeague PWA

§1 Scope

These Terms & Conditions (T&Cs) govern the use of the ProLeague PWA (“Platform”), operated by HAGMAR GmbH & Co. KG (“Provider”). They apply to all registered users of the Platform and its features.

§2 Registration and User Account

• Using the Platform requires registration. The user agrees to provide complete and truthful information during registration.
• The use of the Platform is generally free of charge. However, the Provider reserves the right to display advertisements on the Platform to finance the service.
• Each user may maintain only one personal account.
• Login credentials must be kept confidential and must not be shared with third parties.
• The Provider reserves the right to suspend or delete user accounts in the event of violations or suspected misuse.

§3 Platform Services

• The Platform enables registered users to participate in organized competitions in EA SPORTS FC Pro Clubs (11v11).
• Users can create or join teams, schedule matches, view statistics, upload content (e.g., profile pictures, logos), and use community features.
• The Platform actively fosters communication and networking within the community to support exchange among players, teams, and interested parties, and to enable shared growth.
• The Provider may modify or further develop content and features at any time.

§4 Premium Subscriptions

• Users may purchase paid premium subscriptions with extended features (e.g., advanced statistics, graphics generators, personalization, tournament entries).
• Prices, scope of services, and terms are displayed transparently on the Platform.
• Premium subscriptions renew automatically for the booked term unless terminated in due time.
• Refunds after purchase are excluded unless required by law.

§5 Game Rules & Code of Conduct

• Participation in competitions and use of the Platform require compliance with the official ProLeague Game Rules and Code of Conduct.
• These rules are binding for all users and are accessible on the Platform at all times.
• In the event of violations (e.g., intentional match quitting, insults, deception), the Provider may issue warnings, impose temporary suspensions, or apply permanent sanctions.
• The Game Rules are updated regularly and must be monitored by users on their own responsibility.

§6 Buy-In Systems and Tournament Prizes

• For selected competitions, a buy-in system may apply, requiring teams or players to pay an entry fee.
• Before registration, the Provider will transparently communicate the buy-in amount and any prize money or prizes in kind.
• Prize distribution follows the official tournament rules. Prize money is paid only to team officials or designated recipients.
• Participants are responsible for fulfilling any tax obligations related to prize money.

§7 Team Management

• Teams may be created, managed, and organized by registered users. The respective team manager is responsible for communications, member management, and team compliance with Platform rules.
• The Provider may warn, sanction, or exclude teams from competitions in case of violations.

§8 Youth Protection

• The Platform is generally intended for users aged 16 and above.
• Users under 18 require the consent of their legal guardians for certain features, in particular premium subscriptions or participation in tournaments with prize money.
• The Provider reserves the right to conduct age verification.

§9 User Duties & Content

• It is prohibited to upload content that violates applicable law, third-party rights, or common decency — in particular insulting, racist, pornographic, or copyrighted content without a license.
• By uploading content, the user grants the Provider a non-exclusive, worldwide, and time-unlimited right to use the content for display on the Platform and for reporting.
• The user expressly warrants that they hold all necessary rights — especially for images (e.g., profile pictures, logos, team graphics). No third-party content may be used without the right holder’s permission.
• The Provider reserves the right to remove content without stating reasons.

§10 Liability

• The Provider strives for uninterrupted availability but does not guarantee that the Platform will be accessible at all times.
• The Provider is liable only for intent or gross negligence. In cases of slight negligence, liability is limited to foreseeable damages and only if a material contractual obligation (cardinal duty) is breached.
• The Provider assumes no liability for third-party content (e.g., external links, user content). Upon becoming aware of legal violations, such content will be removed promptly.

§11 Term and Termination

• The free use relationship may be terminated by the user at any time by deleting the account.
• Premium subscriptions can be terminated within the timeframe specified for the subscription. If termination is not effected in time, the subscription renews for the agreed term.
• The Provider may terminate the use relationship at any time for good cause.
• In case of violations of these T&Cs, the Game Rules, or other Platform policies, the Provider may temporarily suspend or permanently deactivate the user account.

§12 Amendments to the T&Cs

• The Provider may amend these T&Cs at any time.
• Users will be informed of amendments at least 14 days in advance.
• If the user does not object within 14 days of notification, the amended T&Cs are deemed accepted.

§13 Privacy

The collection, processing, and use of personal data are carried out exclusively in accordance with applicable data protection laws. Further information can be found in the Privacy Policy.

§14 Copyright

• All Platform content (texts, images, logos, graphics, software components) is protected by copyright and may not be used commercially without the Provider’s prior written consent.
• Reproduction for private purposes is permitted within the scope of the Platform.

§15 Final Provisions

• The laws of the Federal Republic of Germany apply.
• Place of jurisdiction, where legally permissible, is the Provider’s registered office.
• If any provision of these T&Cs is or becomes invalid, the validity of the remaining provisions shall not be affected.

§16 Independence & Financing Notices

• This Platform and its content are not affiliated with Electronic Arts Inc. or its licensors and are not endorsed by them.
• Use of the Platform is generally free of charge. However, to finance the service, the Provider reserves the right to display advertisements on the Platform.

This T&Cs release is Version 1 and remains in force until replaced by a new version.
